Playing the games

The games are free for personal, non-commercial entertainment. Please don’t try to disrupt the service, get around its security, scrape it at scale, or copy and redistribute the games or their artwork.

Accounts and scores

The site is intended for people 13 and older, and you must be at least 13 to create an account. Keep your sign-in details safe; you are responsible for activity on your account. Usernames must not be offensive, impersonate anyone, or infringe anyone’s rights. We may rename, hide, or remove usernames and scores, or suspend accounts, that break these rules or that we reasonably believe were achieved by cheating or tampering. You can stop using your account at any time and ask us to delete it.

Optional tips

Tips are voluntary one-time gifts to support the site. They are paid through PayPal under PayPal’s terms, do not buy any goods, services, stars, or unlocks, and are not refundable except where the law requires.

Ownership

The games, code, artwork, sound, and site design are owned by Cool Monkey Development or its licensors, and all rights are reserved. Playing the games does not give you a license to copy, modify, or redistribute them. Third-party open-source components remain under their own licenses.

Availability

We provide the site “as is” and “as available.” We may change, pause, or remove games, features, scores, or the site itself at any time. To the fullest extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent the law allows, Cool Monkey Development is not liable for indirect, incidental, special, or consequential damages arising from your use of the site, and our total liability for any claim is limited to US$50. Nothing in these terms limits rights or liability that cannot lawfully be limited.

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Dallas County or Tarrant County, Texas, and you and we consent to their jurisdiction, except where the law of your home country or state gives you the right to bring a claim locally.

Changes

We may update these terms. We will change the date above when we do, and continuing to use the site after an update means you accept it.
